The binding contractual terms governing all bookings, services, and interactions with Ideal Adventures Kenya. Please read carefully before making a booking.

Please Read Before Booking

By making a booking and completing payment, you enter into a legally binding contract with Ideal Adventures Kenya Limited and agree to these Terms & Conditions in full. These terms do not affect your statutory rights under Kenyan consumer protection law. Cancellation and refund terms are published in our separate Privacy & Refund Policy.

Definitions

In these Terms and Conditions, the following definitions apply:

"Tour" / "Service"Any safari, trek, excursion, transfer, or travel experience arranged or operated by us.
"Booking Confirmation"The written confirmation email we send after receipt of full or deposit payment, detailing your tour reference, date, and itinerary.
"Itinerary"The day-by-day programme of activities and accommodation described in your Booking Confirmation.
"Force Majeure"Any event beyond our reasonable control — see Clause 8.
"Third-Party Supplier"Any independent provider of accommodation, transport, or services used in delivering your Tour — see Clause 12.
"KTB"Kenya Tourism Board, the statutory body responsible for licensing and regulating tour operators in Kenya.
"KWS"Kenya Wildlife Service, the statutory body managing national parks and wildlife conservancies.
"Writing"Email communication to our confirmed email addresses constitutes valid written communication for the purpose of these Terms.

About Us & Licencing

Ideal Adventures Kenya Limited is a duly incorporated Kenyan company registered under the Companies Act, 2015 (Registration No. PVT-XXXXXXXX) and licensed by the Kenya Tourism Board as a tour operator (Licence No. KTB/TO/XXXX/2024) pursuant to the Kenya Tourism Act, 2011 (Cap. 383).

Our registered business address is: Kimathi Street, Nairobi CBD, P.O. Box XXXXX-00100, Nairobi, Kenya.

We operate exclusively within the Republic of Kenya and arrange inbound travel experiences for domestic and international visitors. We do not operate as a travel agent for international flights or outbound travel from Kenya.

Our KTB licence is renewed annually and subject to compliance with the KTB Tour Operator Code of Conduct, which sets minimum standards for guide qualifications, vehicle safety, wildlife interaction protocols, and customer service.

Acceptance of Terms

These Terms and Conditions ("Terms") govern all bookings made with us, whether through our website, by email, by telephone, or in person.

A binding contract between you and us is formed when:

  • We receive your completed booking request (online form, email, or in person); and
  • We issue a Booking Confirmation by email; and
  • You pay the required deposit or full tour amount.

By completing a booking and making payment, the Lead Booker confirms that they have read, understood, and accepted these Terms in full on behalf of all persons included in the booking. Persons under 18 must have a parent or legal guardian accept these Terms on their behalf.

These Terms govern your booking contract. Our Privacy & Refund Policy governs how we handle your personal data and sets out detailed cancellation refund amounts. Both documents together form the complete agreement between you and us.

The Booking Contract

4.1 Booking Process

  • Complete the online booking form or contact us directly by email or telephone.
  • We will send you a Quotation within 2 business days.
  • To confirm your booking, pay the required deposit (or full amount) within 5 days of receiving the Quotation.
  • Upon receipt of payment, we will issue your Booking Confirmation — this is the point at which a binding contract is formed.
  • Your Booking Confirmation will detail your unique booking reference, tour date(s), itinerary summary, total price paid and any outstanding balance, and payment due dates.

Failure to pay the outstanding balance by the stated due date may result in cancellation of your booking. In that event, the deposit paid will be forfeited in accordance with our cancellation schedule in the Privacy & Refund Policy.

4.3 Accuracy of Booking Details

You are responsible for ensuring that all booking details you provide — including names, passport details, travel dates, and contact information — are accurate and match your travel documents. We accept no liability for loss arising from errors you have made in the information provided.

4.4 Booking Confirmation is Your Travel Document

Your Booking Confirmation email is your primary travel document. Please print or save a copy and bring it on your tour. A failure to present your Booking Confirmation on arrival may delay the start of your tour. We accept no liability for delays caused by a customer's failure to bring required documentation.

Pricing & Payment

5.1 Currency & Pricing

  • All prices displayed on our website are in Kenya Shillings (KES) unless explicitly stated otherwise.
  • Prices are per person unless stated as per group or per vehicle.
  • Quoted prices include all items listed under the tour's "Includes" section and exclude all items listed under "Excludes".
  • International visitors may be quoted in USD for convenience; the final M-Pesa charge is calculated at the prevailing exchange rate on the payment date.

5.2 What Is Typically Included

  • Services and accommodation explicitly listed in your Booking Confirmation.
  • AMREF Flying Doctors emergency medical evacuation cover where indicated.
  • Park and conservancy entry fees where specified in the tour description.
  • Services of our licensed guides and drivers.
  • Transport in our fleet vehicles during the tour programme.

5.3 What Is Typically Excluded

  • International and domestic flights, airport transfers not listed in the itinerary.
  • Passport, visa, and immigration fees.
  • Personal travel insurance (strongly recommended — see Clause 13).
  • Alcoholic beverages, laundry, telephone calls, and other personal expenses.
  • Gratuities and tips for guides, drivers, and lodge staff (entirely at your discretion).
  • Items of a personal nature not listed under "Includes".

5.4 Price Changes Before Booking Confirmation

Prices quoted are valid for 7 days from the date of the Quotation. If you do not confirm and pay within this period, we reserve the right to revise the price before issuing a new Quotation.

5.5 Price Changes After Booking Confirmation

Once your Booking Confirmation has been issued and full payment or a deposit has been received, we will not increase the price of your confirmed tour except where increases are caused by:

  • Changes to national park or conservancy fees imposed by KWS or county governments after your booking was confirmed.
  • Changes to mandatory government taxes or levies (e.g. VAT, Tourism Levy).
  • Significant currency fluctuations exceeding 10% where you booked in a foreign currency.

In the event of a price increase exceeding 10% of the total tour price after confirmation, you are entitled to cancel with a full refund of all amounts paid.

5.6 Payment Methods

  • M-Pesa (Lipa Na M-Pesa): Our primary payment method via Safaricom Daraja STK Push.
  • Bank transfer (EFT): Available on request — bank details provided on the Quotation.
  • Cash (KES): Accepted in person at our Nairobi office for amounts below KES 1,000,000.

🔒 M-Pesa Payment Security

Your M-Pesa PIN is entered on your handset only and is never transmitted to our systems. Payments are processed via the Safaricom Daraja API using TLS encryption. We maintain full payment records for KRA compliance.

5.7 VAT & Tourism Levy

Our quoted prices are inclusive of applicable VAT at the prevailing rate (currently 16%) and the Kenya Tourism Levy (currently 2% of taxable turnover) unless a price is explicitly marked "excl. VAT". VAT receipts are available on request.

Your Obligations

6.1 Documentation

You are solely responsible for ensuring that you and all persons in your booking hold:

  • A valid passport (with at least 6 months validity beyond your return date) or national ID where applicable.
  • Any visa required for entry into Kenya — check current requirements with the Kenya High Commission or Embassy in your home country.
  • Any recommended or mandatory vaccinations (check current Kenya health entry requirements, particularly for yellow fever).
  • Your Booking Confirmation and any permits issued by us.

We accept no liability for any loss, additional costs, or denied participation arising from your failure to hold correct documentation.

6.2 Timekeeping & Meeting Points

Tours depart at the times specified in your Booking Confirmation. You are required to be at the agreed meeting point at least 15 minutes before departure. We will not delay a group departure for a late individual. No refund is payable for missed departure due to your own lateness.

6.3 Conduct

You agree to behave in a manner that does not endanger yourself, other participants, our staff, wildlife, or third parties, and in compliance with:

  • All instructions given by our guides, drivers, and lodge staff.
  • All rules of national parks, conservancies, and accommodation facilities.
  • The Wildlife Conservation and Management Act, 2013 — including prohibitions on approaching, disturbing, or feeding wildlife.
  • All applicable Kenyan laws and regulations.

6.4 Photography & Drone Use

  • Photography for personal use is permitted and encouraged.
  • Commercial photography or videography requires prior written approval from us and, where applicable, from KWS.
  • Drone (UAV) operation in national parks and conservancies is strictly prohibited by KWS regulations without a specific KWS permit. Operating a drone without a permit may result in equipment confiscation and fines. We accept no liability for drones confiscated by KWS.
  • You may not use imagery captured during our tours for commercial purposes without our prior written consent — see Clause 14 (Intellectual Property).

6.5 Compliance with Local Customs

We ask all participants to respect local culture, customs, and dress codes, particularly when visiting cultural sites, Maasai villages, or communities. Our guides will brief you on relevant customs before each activity.

Our Obligations & Service Standards

7.1 Delivery of Services

We undertake to deliver the services described in your Booking Confirmation with reasonable care and skill, in compliance with the KTB Tour Operator Code of Conduct and all applicable Kenyan law.

7.2 Guide Qualifications

  • All our field guides hold valid KTB-accredited guide licences.
  • Guides assigned to mountain treks hold current first aid certifications.
  • Specialist guides (e.g. birding, cultural) hold relevant specialist accreditation.

7.3 Vehicle Safety

  • All safari and transport vehicles are roadworthy, comprehensively insured, and inspected annually.
  • Vehicles are fitted with the required safety equipment including first aid kits.
  • Maximum passenger loads specified by the manufacturer are not exceeded.

7.4 Accommodation Standards

Accommodation used is selected to match the standard described in your Booking Confirmation (budget, mid-range, or luxury). Where a specific property is unavailable due to circumstances beyond our control, we will provide a replacement of equivalent or higher standard at no additional cost, or offer a credit note if this is not possible.

7.5 Communication

We will acknowledge all written enquiries and booking requests within 2 business days. We will notify you of any material changes to your confirmed itinerary with as much advance notice as circumstances permit.

7.6 AMREF Flying Doctors Cover

Where your tour includes AMREF Flying Doctors emergency medical evacuation cover, we will register all participants before departure. This cover applies to medical emergencies in the Kenyan wilderness and does not cover trip cancellation, personal liability, repatriation to your home country, or pre-existing medical conditions unless specifically disclosed and accepted.

Itinerary & Programme Changes

8.1 Minor Changes by Us

We reserve the right to make minor adjustments to a confirmed itinerary where required by circumstances including:

  • Road conditions, flooding, or infrastructure closures.
  • Wildlife movement and KWS park management decisions.
  • Weather conditions rendering an activity unsafe.
  • Accommodation substitution with an equivalent or superior property.

Minor changes do not entitle you to a refund. We will notify you of any minor changes as early as possible.

8.2 Significant Changes by Us

A significant change is one that materially alters the core character of your tour, including:

  • A change of destination (e.g. from Maasai Mara to a different national park).
  • A reduction in tour duration of more than 1 full day.
  • Accommodation downgrade to a materially lower standard than confirmed.

If we make a significant change before departure, you may choose to:

  • Accept the alternative arrangement offered; or
  • Accept a credit note for the full value paid, valid for 18 months; or
  • Cancel and receive a full refund of all amounts paid to us within 14 working days.

8.3 Force Majeure

Force Majeure means any event outside our reasonable control that makes performance of the tour impossible or unlawful, including: acts of God; flood, earthquake, or other natural disaster; outbreak of disease or pandemic declared by the WHO or Kenyan Government; civil unrest or acts of terrorism; government travel advisories; KWS park or conservancy closures; or failure of essential utilities.

In the event of Force Majeure that prevents tour delivery:

  • We will notify you as soon as reasonably practicable.
  • We will offer a credit note valid for 18 months as our primary remedy.
  • Cash refunds will be limited to amounts we are able to recover from third-party suppliers — pre-paid KWS fees, permits, and non-refundable accommodation may be irrecoverable.
  • Neither party will be liable to the other for losses caused by Force Majeure.

We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation due to force majeure. This risk is not covered by AMREF Flying Doctors. See Clause 13.

Health, Safety & Special Requirements

9.1 Your Responsibility to Disclose

Before booking, you must inform us in writing of any medical conditions, physical limitations, disabilities, or dietary requirements that may affect your participation in any activity on the tour. This is for your safety and the safety of others.

Failure to disclose a relevant medical condition may result in you being excluded from an activity on safety grounds without any refund entitlement for that activity.

9.2 Fitness Requirements

  • Game drives: Suitable for all fitness levels. Participants must be able to board a 4x4 vehicle unaided.
  • Bush walks: Moderate fitness required — participants walk 5–15km on uneven terrain.
  • Mount Kenya summit trek: High fitness level required. All summit participants must complete our pre-departure fitness and acclimatisation briefing. Participants with cardiovascular conditions, severe asthma, or uncontrolled hypertension should obtain medical clearance before booking.
  • Cycling activities: Basic cycling ability required. Inform us of any cycling experience level.

9.3 Children

  • Children under 7 years are not permitted on bush walking activities for safety reasons.
  • Children under 12 years are not permitted on the Mount Kenya summit route.
  • All participants under 18 must be accompanied by a parent or legal guardian throughout the tour.
  • We do not provide unaccompanied minor services.

9.4 Altitude & Environmental Risks

For mountain treks above 3,500m, you acknowledge the inherent risks of altitude sickness (AMS), including in extreme cases High-Altitude Pulmonary Oedema (HAPE) and High-Altitude Cerebral Oedema (HACE). Our guides are trained in AMS recognition and first response. By booking a mountain trek, you accept these inherent risks.

9.5 Wildlife Risks

Safari activities take place in wild environments inhabited by dangerous animals. By participating, you acknowledge the inherent risks of wildlife encounters and agree to follow all safety instructions given by our guides and KWS rangers at all times. Disregarding safety instructions that result in injury or death is done entirely at your own risk.

9.6 Vaccinations

You are responsible for obtaining any recommended or mandatory vaccinations before your tour. Current requirements for Kenya may include yellow fever (for arrivals from endemic countries), as well as recommended vaccines such as hepatitis A/B, typhoid, and malaria prophylaxis. Check with your doctor and the Kenya High Commission in your country before travel.

Excluded & Removed Participants

10.1 Right to Exclude from Booking

We reserve the right to decline or cancel a booking where we reasonably believe a participant:

  • Has a medical condition that poses an unacceptable safety risk to themselves or others.
  • Does not meet the minimum fitness or age requirements for the booked activity.
  • Has provided materially false or misleading information in their booking.
  • Has previously caused a serious safety incident on one of our tours.

10.2 Right to Remove During a Tour

Our lead guide has the right, in their sole reasonable discretion, to remove a participant from a tour at any point if the participant:

  • Behaves in a manner that endangers themselves, other participants, staff, or wildlife.
  • Refuses to follow reasonable safety instructions from our guide or KWS rangers.
  • Is intoxicated or under the influence of illegal substances to a degree that creates a safety risk.
  • Breaches any term of these Terms and Conditions in a material way.

A participant removed from a tour during the programme will not be entitled to a refund for the remaining portion of the tour. We will arrange return transport to the nearest town at the participant's own cost, where reasonably practicable.

Limitation of Liability

⚠ Please Read This Section Carefully

This clause limits our financial liability to you. Nothing in this clause limits our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation, which we cannot legally exclude.

11.1 Our Maximum Liability

Subject to Clause 11.4, our total financial liability to you in connection with any tour shall not exceed the total amount paid by you to us for that specific confirmed booking.

11.2 Indirect Losses

We are not liable for any indirect, consequential, or special losses arising from our services or their failure, including but not limited to: loss of profit, loss of enjoyment, additional travel or accommodation costs you incur due to tour changes, or business losses of any kind.

11.3 Events Outside Our Control

We are not liable for any failure to deliver services caused by Force Majeure (Clause 8.3), road closures, flight delays by third-party carriers, or actions of government authorities.

11.4 What We Cannot Exclude

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our proven negligence.
  • Fraudulent misrepresentation by us.
  • Any liability that cannot lawfully be excluded under the Consumer Protection Act, 2012 or other mandatory Kenyan law.

11.5 Wildlife & Activity Inherent Risks

You acknowledge that safari, trekking, cycling, and other outdoor activities carry inherent risks that cannot be entirely eliminated. By participating, you voluntarily accept these risks and acknowledge that our guides take all reasonable precautions. We are not liable for injury, illness, or death arising from inherent risks of activities that were not caused by our negligence.

11.6 Personal Property

We are not liable for loss, theft, or damage to personal property during tours, including camera equipment, luggage, or valuables. We strongly recommend comprehensive travel insurance covering personal effects — see Clause 13.

Third-Party Suppliers

12.1 Our Role as Principal vs. Agent

Where we arrange your tour in its entirety as a package, we act as the principal and are responsible for ensuring the overall package meets the standard described in your Booking Confirmation.

Where we arrange individual services on your behalf — such as booking a domestic flight or specialist activity with an independent provider — we may act as your agent. In this case, your contract for that service is directly with the third-party supplier and their own terms and conditions will apply.

12.2 Third-Party Conduct

We are not liable for the acts, omissions, or negligence of independent third-party suppliers — such as airlines, independent lodges, or activity providers — where we have acted as your agent, or where the supplier's failure arose from causes beyond our control.

12.3 KWS and Park Authorities

National parks, conservancies, and wildlife reserves are managed by Kenya Wildlife Service and county or private conservancy authorities. Their rules, access restrictions, and closures apply independently of our tour contracts. We are not liable for park closures, route restrictions, or access changes imposed by KWS or conservancy management.

12.4 Accommodation

Our accommodation partners are independently operated and maintain their own terms of service. Complaints about accommodation facilities should be raised with us immediately during your tour so we can address them. Post-tour complaints about accommodation must be submitted to us in writing within 14 days of your return date.

Travel Insurance

🛡 Travel Insurance Is Strongly Recommended

Comprehensive travel insurance is not included in our tour prices (except AMREF emergency evacuation where noted) and is the sole responsibility of each participant. We strongly recommend purchasing a policy before confirming your booking.

Your travel insurance policy should ideally cover:

  • Trip cancellation or curtailment for any reason, including illness, bereavement, or force majeure.
  • Emergency medical treatment in Kenya, including hospitalisation.
  • Emergency medical evacuation — including to Nairobi and to your home country (AMREF cover is limited to in-country evacuation).
  • Personal liability in the event you cause loss or injury to a third party.
  • Loss, theft, or damage to personal effects and camera equipment.
  • Delayed or missed departure due to airline or transport issues.

We recommend consulting a licensed insurance broker or your bank's travel insurance offering. For Kenya-based travelers, several local insurers offer comprehensive safari travel cover.

We are not licensed to sell or recommend specific insurance products. Any insurance information we provide is for guidance only and does not constitute financial advice.

Intellectual Property

14.1 Our Website Content

All content on our website — including text, tour descriptions, itineraries, photographs, logos, graphics, and page design — is the intellectual property of Ideal Adventures Kenya Limited or our licensed content providers and is protected by Kenyan and international copyright law.

You may view, print, or download content from our website for personal, non-commercial use only. You may not copy, reproduce, distribute, publish, or create derivative works from our content without our prior written consent.

14.2 Your Photographs & Reviews

Photographs and videos you take during our tours are your own and we make no claim to ownership. You may share them freely for personal purposes.

If you share a public review or photograph of your tour on social media or review platforms and tag us, you grant us a non-exclusive, royalty-free licence to share or repost your content for promotional purposes, crediting you where possible. You may withdraw this licence at any time by contacting us.

14.3 Commercial Use

Any commercial use of our tour programmes, itineraries, copyrighted photographs, or branding requires a separate written agreement. Contact legal@idealadventureskenya.com.

Website Use

15.1 Permitted Use

Our website is provided for the purpose of viewing our tour offerings, making enquiries, and completing bookings. You agree to use it only for lawful purposes and in accordance with these Terms.

15.2 Prohibited Conduct

You agree not to:

  • Use our website in any way that violates any applicable Kenyan law or regulation.
  • Attempt to gain unauthorised access to our systems, servers, or databases.
  • Introduce malware, viruses, or any harmful code.
  • Use automated tools to scrape, harvest, or extract content from our website.
  • Submit false, misleading, or fraudulent booking information.

15.3 Availability

We do not guarantee that our website will always be available or error-free. We may suspend, withdraw, or restrict access for business or technical reasons without notice. We are not liable for any loss caused by our website being temporarily unavailable.

Our website is governed by the Electronic Transactions Act, 2022 (Kenya), which gives legal effect to electronic records and electronic signatures for the purposes of your booking.

Complaints Procedure

16.1 During Your Tour

If you experience a problem during your tour, please raise it immediately with your guide or our operations team by calling +254 700 000 000. Raising concerns at the time allows us the opportunity to resolve them promptly. Complaints raised only after a tour has ended are significantly harder to resolve satisfactorily.

16.2 Post-Tour Complaints

Written complaints must be submitted to info@idealadventureskenya.com within 30 days of the end of your tour. We will acknowledge complaints within 5 business days and provide a substantive response within 21 business days.

Complaints about accommodation must be submitted within 14 days of your return.

16.3 Escalation

If you are unsatisfied with our response, you may escalate to:

  • Kenya Tourism Board Consumer Complaints Committee: www.tourismkenya.org
  • Consumer Protection Advisory Committee under the Consumer Protection Act, 2012.
  • Mediation through the Nairobi Centre for International Arbitration (NCIA) — see Clause 17.

Governing Law & Disputes

17.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Kenya.

17.3 Jurisdiction

Subject to the dispute resolution steps above, the parties submit to the exclusive jurisdiction of the courts of Kenya for the resolution of any dispute not settled by negotiation, mediation, or arbitration.

General Provisions

18.1 Entire Agreement

These Terms, together with your Booking Confirmation and our Privacy & Refund Policy, constitute the entire agreement between you and us in relation to your tour and supersede all prior representations, warranties, or agreements.

18.2 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

18.3 No Waiver

A failure by us to exercise or enforce any right under these Terms shall not constitute a waiver of that right and shall not prevent us from subsequently exercising or enforcing that right.

18.4 Assignment

You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without our prior written consent. We may assign our obligations to a successor business in connection with a sale or transfer of our business.

18.5 Electronic Execution

In accordance with the Electronic Transactions Act, 2022 (Kenya), completing a booking via our website constitutes a valid electronic agreement and is legally binding on the same terms as a signed written contract.

18.6 Language

These Terms are written in English. In the event of any conflict between an English version and any translation, the English version shall prevail.

18.7 Updates to These Terms

We may update these Terms from time to time. Changes will be posted on our website with an updated effective date. For bookings already confirmed, the Terms in force at the time of your Booking Confirmation apply throughout your tour, unless you agree in writing to accept updated Terms.
